“Anti-Aging” Products Class Action Investigation

“Anti-aging” skin creams are prevalent in pharmacies, supermarkets, and department stores throughout Massachusetts and America.  Amazon, CVS, Rite-Aid, Walgreens, Macy’s, and even Whole Foods sell an ever-increasing array of “anti-aging” products. Currently, “anti-aging lotions and potions are now 13 percent of all cosmetic sales and growing.”  Cosmetics companies have been selling products like these since the 1940′s, with marketing slogans such as:“I never dreamed I’d look this young at my age.”

The seminal case on the subject of deceptive marketing and age-defying skin cream is Charles of the Ritz Distribution v. FTC, 143 F.2d 676 (1944),  in which the Commission found:

“…regardless of the condition of the skin or the age of the user, since external applications of cosmetics cannot overcome skin conditions which result from systemic causes or from physiological changes occurring with the passage of time and since there is no treatment known to medical science by which changes in the condition of the skin of an individual can be prevented or by which an aged skin can be rejuvenated or restored to a youthful condition.”advertising falsely represented that Rejuvenescence Cream will rejuvenate or restore youth or the appearance of youth to the skin,

Today, the “anti-aging” claims being made by skin cream companies may go far beyond anything that can be supported by real science.  Marketing campaigns include buzzwords such as “stem cells,” “gene science,” and “cell regeneration.”  The inventiveness of modern cosmetic companies’ marketing teams is impressive; one leading product line contains an array of over 25 different anti-aging skin creams, elixirs, peels, gadgets, and eye-lifting serums!

The issue of whether an adequate scientific basis exists for many of the claims affixed to modern “anti-aging” products is currently being tested by consumer protection lawyers through anti-wrinkle cream class actions – and by the FDA, through a series of recent warning letters.

Dermatologists interviewed for an article entitled “Do anti-aging skin creams work,”  said “your skin likely won’t be miraculously transformed.

    I used to be on some crazy skin care regimen, I had to wake up early to even have time to get the thing done before work. Looking back I basically paid them all my money for wet perfume for my face. At least I smelled good? I love this blog. 🙂 I looked younger only because I was twenty and my skin hadnt caught up with all the mess I put it through not because of some cream…but at any age you just have to believe
